Please review every section below. Accepting these terms means you understand how accounts are managed, how billing works, and what happens if something goes wrong.

Acceptance of Terms

  • •By accessing or using the Crittiks platform, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms apply to all users, including agencies, freelancers, clients, and team members who access the platform.
  • •Your continued use of Crittiks constitutes acceptance of any updates or modifications to these terms. We recommend reviewing this page periodically to stay informed of any changes.

Eligibility

  • •You must be at least 16 years old to use Crittiks. If you are using Crittiks on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

User Accounts

  • •When you create an account, you agree to: Provide accurate, current, and complete information; Maintain and promptly update your account information; Maintain the security of your password and account; Accept responsibility for all activities under your account; Immediately notify us of any unauthorized use of your account.
  • •You are solely responsible for any activity that occurs under your account, whether or not you authorized it. We are not liable for any loss or damage arising from your failure to maintain account security.

Acceptable Use Policy

  • •You agree to use Crittiks in accordance with all applicable laws and regulations. You may not: Violate any laws, regulations, or third-party rights; Upload malicious code, viruses, or harmful software; Attempt to gain unauthorized access to any part of the platform; Interfere with or disrupt the platform's operation or servers; Use the platform for illegal, fraudulent, or harmful purposes; Harass, abuse, or harm other users; Impersonate any person or entity; Scrape, crawl, or use automated tools to access the platform without permission; Resell, redistribute, or sublicense the platform without authorization.
  • •Violation of this policy may result in immediate suspension or termination of your account.

Subscription and Billing

  • •Crittiks offers both free and paid subscription plans. By subscribing to a paid plan, you agree to: Pay all fees associated with your chosen subscription plan; Provide accurate billing information; Authorize automatic recurring charges to your payment method; Pay any applicable taxes, duties, or surcharges.
  • •Billing Cycle: Subscriptions are billed monthly or annually based on your chosen plan. Billing occurs on the same day each billing cycle.
  • •Price Changes: We may change our pricing at any time. We will provide at least 30 days advance notice of any price increases. Your continued use after a price change constitutes acceptance of the new pricing.
  • •Refunds: Refunds are provided on a case-by-case basis within 14 days of initial purchase. Contact billing@crittiks.com for refund requests.

Cancellation and Termination

  • •Your Right to Cancel: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will not be charged for subsequent periods.
  • •Our Right to Terminate: We reserve the right to suspend or terminate your account if you violate these terms, engage in fraudulent activity, or if we believe your use poses a security risk.
  • •Data After Termination: Upon account termination, you have 30 days to export your data. After 30 days, your data will be permanently deleted.

Intellectual Property Rights

  • •Your Content: You retain all ownership rights to the content, data, and files you upload to Crittiks. By using our platform, you grant us a limited license to host, store, process, and display your content solely to provide our services.
  • •Our Platform: Crittiks and all related trademarks, logos, and service marks are the property of CRITTIKS GROUP PTY LTD. The platform's design, code, features, and functionality are protected by copyright, trademark, and other intellectual property laws.
  • •You may not copy, modify, distribute, sell, or lease any part of our platform without our express written permission.

User Content and Responsibility

  • •You are solely responsible for all content you create, upload, share, or transmit through Crittiks. You represent and warrant that: You own or have the necessary rights to all content you upload; Your content does not infringe on any third-party rights; Your content complies with all applicable laws and regulations; Your content does not contain viruses, malware, or harmful code.
  • •We do not pre-screen user content, but we reserve the right to remove any content that violates these terms or is otherwise objectionable.

Service Availability and Modifications

  • •We strive to maintain high availability and reliable access to Crittiks, but we cannot guarantee uninterrupted service. The platform may be temporarily unavailable due to maintenance, updates, technical issues, or circumstances beyond our control.
  • •We reserve the right to modify, suspend, or discontinue any aspect of the platform at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of services.

Disclaimer of Warranties

  • •Crittiks is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to: Implied warranties of merchantability, fitness for a particular purpose, or non-infringement; Guarantees of uninterrupted, timely, secure, or error-free service; Accuracy, reliability, or quality of any content or information.
  • •Your use of Crittiks is at your sole risk. We do not warrant that the platform will meet your requirements or that defects will be corrected.

Limitation of Liability

  • •To the maximum extent permitted by law, CRITTIKS GROUP PTY LTD, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: Loss of profits, data, use, goodwill, or other intangible losses; Unauthorized access to or alteration of your content; Statements or conduct of any third party on the platform; Any other matter relating to the platform.
  • •Our total liability shall not exceed the amount you paid us in the 12 months preceding the event giving rise to liability, or $100 AUD, whichever is greater.

Indemnification

  • •You agree to indemnify, defend, and hold harmless CRITTIKS GROUP PTY LTD from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from: Your use or misuse of the platform; Your violation of these terms; Your violation of any rights of another party; Your content or data uploaded to the platform.

Dispute Resolution

  • •Governing Law: These terms are governed by the laws of Victoria, Australia, without regard to conflict of law principles.
  • •Dispute Resolution: Any disputes arising from these terms or your use of Crittiks will be resolved through binding arbitration in Victoria, Australia, except where prohibited by law.

Changes to These Terms

  • •We may modify these Terms of Service at any time. When we do, we will: Update the "Last updated" date at the top of this page; Notify you via email or platform notification for material changes; Provide you with an opportunity to review the changes before they take effect.
  • •Your continued use of Crittiks after changes to these terms constitutes your acceptance of the modified terms.

Severability

  • •If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
